These Terms and Conditions (“Terms”) set out the contractual terms applicable to sales of products by Nanosupps Kft. through the online store operated at www.nanosupps.com (“Website”). The individual contract between the Service Provider and the Customer includes these Terms, the order data and the pre-contractual information on the Website concerning the relevant product, price, delivery and payment.
The applicable legal framework includes, in particular, Act V of 2013 on the Civil Code, Act CVIII of 2001 on certain issues of electronic commerce services, Act CLV of 1997 on consumer protection, Government Decree 45/2014 (II. 26.), Government Decree 373/2021 (VI. 30.), and applicable EU consumer-protection and food-law provisions.
2. Scope, consumer status and international sales
2.1. A Customer is any natural or legal person, or organisation with legal capacity, placing an order on the Website. A consumer is a natural person acting outside their profession, independent occupation or business activity within the meaning of Section 8:1(1)(3) of the Hungarian Civil Code.
2.2. Provisions applicable exclusively to consumers apply to a Customer who is not a consumer only where required by law or expressly provided for in these Terms.
2.3. The online store operates in Hungarian and English and permits purchases in Hungarian forints and euros. At launch, Nanosupps plans to sell to Hungary, EU Member States, the United States, Canada, the United Kingdom, Switzerland, Norway, Iceland, Ukraine, Albania, Andorra, Bosnia and Herzegovina, Liechtenstein, Montenegro, North Macedonia, Serbia, Kuwait, Qatar, Saudi Arabia and the United Arab Emirates, provided that product-distribution and import requirements for the destination country are met. Countries and delivery options actually available are shown by the current checkout settings.
Nanosupps states that it verifies the applicable distribution, labelling, language, import and other local-compliance requirements for each destination country within its own team. These Terms do not replace an assessment of compliance with mandatory local law in each destination country.
2.4. The law governing consumer contracts is determined under Regulation (EC) No 593/2008, in particular Article 6. A choice of Hungarian law may not deprive a consumer of protection afforded by non-derogable consumer-protection provisions of their habitual residence where the Service Provider directs its activities to that country.
2.5. Jurisdiction is governed by the applicable EU and national procedural rules. These Terms do not restrict a consumer from enforcing rights before a court designated by mandatory applicable law.
3. Products, food supplements and product information
3.1. The online store principally markets food supplements, sports-nutrition products, protein and collagen products, amino-acid and creatine products, pre-workout products, protein-rich snacks, beverages and related products. The material characteristics, composition, pack size, use, price and warnings necessary for consumption are stated on the relevant product page.
3.2. In distance sales of prepacked food, mandatory food information, except the date of minimum durability, must be made available before completion of the purchase pursuant to Article 14(1) of Regulation (EU) No 1169/2011. All mandatory information must be available at delivery. Product information on the Website must therefore be maintained in a current form consistent with the information on the packaging.
3.3. In accordance with Section 6(2) of Hungarian Decree 37/2004 (IV. 26.) ESzCsM, labelling, presentation and advertising of food supplements may not attribute disease-preventing or curative effects to a product, nor refer to such effects. Health claims may be used only subject to the conditions of Regulation (EC) No 1924/2006, in particular Articles 3 and 10.
3.4. Food-supplement labelling must include the recommended daily amount, a warning not to exceed it, a statement that supplements are not substitutes for a varied diet, and a warning to keep the product out of reach of young children. Further product-specific warnings required by applicable rules and the final product label must also appear on the product page. Nanosupps does not apply a general 18+ restriction to the whole online store. Any age-related consumption warning justified by law, composition or manufacturer information is displayed on the relevant product page in accordance with the final label.
3.5. At the latest when a food supplement is first marketed in Hungary, the manufacturer or importer must notify the National Public Health and Pharmaceutical Centre (NNGYK), submitting the data and label required by the applicable decree. Nanosupps must establish for each product whether it acts as manufacturer, importer or in another distribution role, and ensure or verify fulfilment of the corresponding notification duty. Registration by NNGYK and its official certificate do not constitute a marketing authorisation or, by themselves, prove compliance with every legal requirement.
3.6. The Service Provider also fulfils consumer-information requirements applicable from 27 September 2026 under Government Decree 116/2026 (VII. 30.). The harmonised notice regarding the statutory obligation to guarantee conformity of goods under Commission Implementing Regulation (EU) 2025/1960 must be prominently available. Where a manufacturer gives a commercial guarantee of durability and informs the Service Provider, or where repairability or software-update information is relevant, the statutory further information will also be provided. These duties are not discharged solely by publishing these Terms; mandatory information must also appear in the relevant areas of the online store.
4. Prices, promotions, unit prices and taxes
4.1. The sale price stated next to a product is displayed in HUF or EUR according to the market settings of the online store. Before the order is finalised, the total payable by the consumer must include applicable taxes and all known mandatory charges. Delivery charges and any other costs are clearly shown during checkout before the order is submitted.
4.1.1. For destinations outside the EU and EEA, the purchase price and delivery charge payable in the online store generally do not include customs duty, import VAT, customs-clearance fees or other local public charges arising in the destination country. The recipient bears these charges under clause 8.5.
4.2. Where legislation requires a unit price, the Service Provider displays it alongside the sale price in accordance with Section 2 of Joint Decree 4/2009 (I. 30.) NFGM-SZMM.
4.3. When announcing a price reduction, the Service Provider applies the prior price under Section 2/A of Joint Decree 4/2009 (I. 30.) NFGM-SZMM. The prior price is generally the lowest price applied during at least the 30 days preceding the reduction. Whether the rules on announcements of price reductions apply to coupons, personalised discounts, loyalty-programme discounts, bundle offers and quantity discounts depends on the actual substance of the offer. Material conditions are communicated with the relevant offer.
4.4. In the event of an obvious technical or data-entry error, especially a price which the Customer could reasonably recognise as erroneous, the Service Provider may correct the error before the contract is concluded and inform the Customer of the correct terms. For a concluded contract, the consequences of mistake are assessed under the Civil Code.
5. Technical steps of ordering and correction of data-entry errors
5.1. The Customer places the product in the cart, enters the data requested during checkout, selects delivery and payment methods, reviews the aggregate order data, then submits the order by a button clearly indicating an obligation to pay.
5.2. Before submitting an order, the online store must provide effective and accessible technical means for identifying and correcting data-entry errors. Before finalising the order, the Customer may go back and change cart contents, quantity and supplied data by the functions made available.
5.3. The final-order button or function must clearly indicate that its activation creates a payment obligation.
5.4. Material information must be displayed clearly and prominently during checkout immediately before the consumer makes their declaration.
5.5. At the latest at the start of the ordering process, the Website must clearly indicate delivery restrictions and accepted payment methods.
6. Order confirmation and conclusion of the contract
6.1. Submission of an order is the Customer’s offer to contract. The Service Provider immediately confirms electronic receipt of the order electronically. If this confirmation is not received within 48 hours after submission, the Customer is released from the offer or contractual commitment.
6.2. An automated email confirming receipt does not itself constitute acceptance where it merely confirms technical receipt of the order.
6.3. The contract is concluded when the Service Provider accepts the order through the Shipping Confirmation email sent by Shopify. Sending the Shipping Confirmation also indicates that, after processing, the product has been handed over for delivery. The preceding Order Confirmation only technically confirms receipt of the order.
6.4. After conclusion of a distance contract, the Service Provider sends the consumer the confirmation required by Section 18 of Government Decree 45/2014 (II. 26.) on a durable medium, at the latest when the goods are delivered.
6.5. The contract language is Hungarian or English according to the Website version used by the Customer. The contract is not separately recorded in paper form. On every amendment of these Terms, the Service Provider archives a separate dated PDF version that is not later overwritten. The version number or date of the Terms and the location of the archived PDF are retained with the relevant order. The Customer receives order-related electronic confirmations on a durable medium.
7. Payment
7.1. The online store offers card payment, Apple Pay and Google Pay through Shopify Payments. Cash on delivery and bank transfer are not available at launch. Actual availability may vary according to the Customer’s country, device and Shopify Payments’ current technical conditions.
7.2. Shopify Payments handles the payment transaction. Its current applicable terms also govern the payment service.
7.3. The Service Provider issues invoices using the Számlázz.hu system. A business Customer may be asked to provide its tax number for invoicing.
8. Fulfilment, delivery and performance
8.1. iLogistic Kft. performs warehousing, order preparation, packing and handover for delivery. Nanosupps Kft. directly handles returns and physical return goods. Return address: 2600 Vác, Szent László út 23/5., Hungary. iLogistic does not handle returns.
8.2. In Hungary, GLS, MPL, Express One and FoxPost participate in delivery, including available collection-point and locker options. Abroad, delivery is primarily made by GLS and DHL. In some cases collection-point selection is handled through a Delivery Gateway integration. The carrier and collection method actually available depend on the destination country and current checkout settings.
8.3. Delivery charges vary by zone and country. Zone-based pricing applies up to 5 kg; above 5 kg charges become weight-based. Estimated delivery is generally 1–2 business days in Hungary, 2–5 business days within the EU and 3–7 business days for more distant destinations. The current delivery charge and conditions of any free delivery are shown before the order is submitted.
8.4. In consumer contracts, risk passes to the consumer under the Civil Code rules on consumer sales. If the carrier was commissioned by the consumer and not offered by the Service Provider, a different rule on transfer of risk may apply.
8.5. Deliveries to destinations outside the EU and EEA are generally DAP in nature under Nanosupps’ current business model. The Customer pays the price of the products and the delivery charge displayed in the online store. The recipient must bear and pay any customs duty, import VAT, customs-clearance fee, official charge and other local burden arising in the destination country. This is clearly communicated before ordering. The DAP designation does not limit non-derogable consumer rights, including mandatory rules on transfer of risk.
8.6. If the recipient refuses to pay properly pre-disclosed import charges, or fails for reasons attributable to them to cooperate in the import procedure, so that delivery fails or the consignment is returned, refusal of delivery does not in itself constitute the consumer’s unequivocal withdrawal notice. Settlement for a returned consignment is governed by mandatory consumer-protection rules. Recovery or set-off of actual, documented return-shipping, customs-clearance, storage or other additional costs caused by the Customer is possible only where statutory conditions are met.
8.7. If an ordered product is unavailable after contract conclusion, the Service Provider informs the Customer without undue delay and, if performance has become definitively impossible, refunds the amount paid in accordance with law.
8.8. Partial performance or a substitute product may be used only by agreement with the Customer or under conditions permitted by law. No other product is sent instead without the Customer’s prior consent.
9. Consumer right of withdrawal
9.1. Consumers have a right to withdraw without giving reasons under Section 20 of Government Decree 45/2014 (II. 26.). For sales of goods, the period is generally 14 days from receipt of the goods by the consumer or a third party designated by the consumer other than the carrier. The consumer may exercise the right between conclusion of the contract and receipt of the goods.
9.2. The right may be exercised with the statutory model form, a clear declaration, or in a distance contract by the online withdrawal function.
9.3. The Service Provider provides a continuously available, prominent and easily accessible online withdrawal function throughout the withdrawal period. At launch it intends to use Shopify’s built-in Return + Refund order-management flow. Its configuration must comply with Section 22(1a)–(1c) of Government Decree 45/2014 (II. 26.), including an access point called “withdrawal from the contract”, a “confirm withdrawal” function and an immediate confirmation on a durable medium.
9.4. A withdrawal notice may be sent by email to letstalk@nanosupps.com, by post to Nanosupps Kft., 1213 Budapest, Szent István út 292/A., Hungary, or through the Website’s online withdrawal function.
9.5. Within 14 days of communicating withdrawal, the consumer must send back or hand over the goods to Nanosupps Kft. at 2600 Vác, Szent László út 23/5., Hungary, unless the Service Provider has undertaken to collect them or the goods have not yet been dispatched or delivered. For statutory withdrawal without giving reasons, the consumer bears the direct cost of return; the Service Provider does not provide free returns or a prepaid return label.
9.6. Within 14 days of learning of withdrawal, the Service Provider refunds all amounts paid by the consumer, including the cost of the least expensive usual delivery method. Refund is generally made using the same method of payment. The Service Provider may withhold the refund in the cases specified in Section 23(4) of Government Decree 45/2014 (II. 26.).
9.7. The consumer is liable only for diminished value resulting from use beyond that necessary to establish the nature, characteristics and functioning of the goods, provided they have been properly informed of the right of withdrawal.
10. Exceptions to withdrawal and opened food supplements
10.1. A consumer may not exercise the right of withdrawal in the cases set out in Section 29(1) of Government Decree 45/2014 (II. 26.).
10.2. Under Section 29(1)(e), withdrawal is unavailable for sealed goods which are not suitable for return for health-protection or hygiene reasons after unsealing following delivery. Depending on the product, Nanosupps products may be sold in induction-sealed bottles, airtight film or aluminium cans with their original seal. The exception applies if the consumer has opened or damaged that seal and the product is consequently unsuitable for return for health-protection or hygiene reasons.
10.3. Withdrawal is also excluded under Section 29(1)(d) for goods liable to deteriorate or expire rapidly. Applicability is assessed by the specific characteristics of the product.
11. Statutory warranty, product liability warranty and guarantee
11.1. Statutory warranty for defects. In the case of defective performance, consumers may assert a statutory warranty claim under Sections 6:159–6:167 of the Civil Code and, for consumer sales of goods, Government Decree 373/2021 (VI. 30.). Subject to statutory conditions, the consumer may require conformity, primarily repair or replacement, or in the cases set out in Section 12 of that Decree a proportionate price reduction or termination of the contract. The claim arising from a sale of movable property between consumer and business expires after two years. The statutory presumption of defect applies to a defect recognised within one year of performance in accordance with Government Decree 373/2021 (VI. 30.).
11.2. Product liability warranty. In the case of a defect in movable property, a consumer may assert a product liability warranty claim against the manufacturer under Sections 6:168–6:170 of the Civil Code, requesting repair or replacement subject to statutory conditions.
11.3. Guarantee. Food supplements and food products are not in themselves subject to the mandatory guarantee for certain durable consumer goods. If the online store later sells a new durable consumer good within the scope of Government Decree 151/2003 (IX. 22.), mandatory guarantee rules apply to that product.
11.4. Handling claims. Consumer warranty and guarantee claims are handled under Decree 19/2014 (IV. 29.) NGM. A record must be drawn up, a copy made available immediately in a verifiable way, and where the claim cannot be assessed on notification the consumer must be informed within 8 days of the Service Provider’s position, the reasons for rejection and the possibility of approaching a conciliation body. Records are retained for three years. The Service Provider endeavours to complete repair or replacement within 15 days and informs the consumer of the expected duration if longer.
12. Complaints handling
12.1. Customers may submit a complaint concerning the Service Provider’s conduct, activity or omission electronically at letstalk@nanosupps.com or by post to Nanosupps Kft., 1213 Budapest, Szent István út 292/A., Hungary. No separate customer-service telephone number is maintained at launch.
12.2. Handling of oral complaints and response to written complaints are governed by Section 17/A of the Consumer Protection Act. Written complaints are answered in writing, substantively and verifiably within 30 days of receipt. A rejection must be reasoned. If an electronic complaint form is made available in the future, its receipt will be promptly acknowledged at the email address supplied by the consumer.
12.3. Upon rejection, the Service Provider informs the consumer, with the content required by Section 17/A(8) of the Consumer Protection Act, which authority or conciliation body may be approached according to the nature of the complaint, and provides the necessary contact details.
12.4. The Service Provider retains records of oral complaints, written complaints and copies of substantive responses for three years.
12.5. Notification of a statutory warranty or guarantee claim is not the same as a complaint under the Consumer Protection Act; the procedural rules of Decree 19/2014 (IV. 29.) NGM apply in particular to such claims.
13. Conciliation body and enforcement of consumer rights
13.1. If a consumer cannot settle a consumer dispute directly with the Service Provider, they may apply to a conciliation body. The procedure is free and the business has a statutory duty to cooperate. For rules concerning conciliation bodies, further entities defined in Section 2 of the Consumer Protection Act, including micro, small and medium-sized enterprises where the conditions are met, may also be considered consumers.
13.2. As a rule, the regional conciliation body competent for the consumer’s residence or place of stay acts. Subject to statutory conditions, the consumer may request another body. Because of Nanosupps Kft.’s registered office, the details of the Budapest Conciliation Board are also stated separately: Budapest Conciliation Board, 1016 Budapest, Krisztina krt. 99.; postal address: 1253 Budapest, P.O. Box 10; email: bekelteto.testulet@bkik.hu.
The postal addresses of regional conciliation bodies are in Annex 2. They were checked against official information available from the Hungarian Chamber of Commerce and Industry on 21 September 2026.
13.3. In consumer-protection authority matters, the consumer may contact the metropolitan or county government office acting in consumer-protection matters. National professional coordination and country-wide consumer-protection duties are performed by the National Trade and Consumer Protection Authority under current designation rules.
13.4. The European Commission’s former online dispute-resolution platform ceased to operate on 20 July 2025. The Website and these Terms therefore do not refer to the ODR platform.
14. Data processing and electronic communications
14.1. Detailed rules for processing personal data are contained in the separately available Privacy Notice on the Website. Separate subscription information applies to newsletters and electronic direct-marketing processing.
14.2. Transactional emails necessary to perform the contract, including confirmation of order receipt, confirmation of contract conclusion, invoicing and delivery notifications, are not marketing messages. Their content must not be used to insert advertising without consent into necessary transactional communication.
15. Protein Snacking Club loyalty programme
15.1. At launch, the Service Provider operates the Protein Snacking Club loyalty programme using the JeriCommerce Shopify integration. Its detailed terms are in Annex 3.
15.2. The Privacy Notice governs processing of personal data relating to the loyalty programme.
16. Intellectual property
16.1. Unauthorised use of content on the Website protected by copyright or industrial-property rights is prohibited. Trademarks and other protected designations of product manufacturers, brand owners and other right holders remain their property.
16.2. Viewing the Website does not itself grant the Customer a right to copy, adapt or distribute its content for commercial purposes.
17. Amendments and final provisions
17.1. The Service Provider may amend these Terms prospectively. An amendment applies from the effective date published on the Website and does not affect contracts already concluded before that date, unless its application is mandatorily required by law.
17.2. If any provision is invalid, void or unenforceable, this does not itself affect the validity of the remaining provisions. In consumer contracts, non-derogable consumer-protection provisions take precedence.
17.3. These Terms are governed by Hungarian law, provided that the mandatory consumer-protection laws specified in clause 2.4 cannot be excluded in an international consumer contract.
Effective from: 19 October 2026

Annex 3 – Protein Snacking Club Loyalty Programme Rules
1. Programme operator and joining
1.1. Protein Snacking Club is Nanosupps Kft.’s loyalty programme. The digital club card can be used in Apple Wallet or Google Wallet without downloading a separate mobile app.
1.2. Joining requires a Shopify customer account and at least one completed purchase in the online store. There is no minimum purchase value and membership is free. The Service Provider does not set a separate minimum age; the joining person’s capacity to contract is governed by applicable law.
2. Earning points
2.1. At the base level, 1 point is awarded for every HUF 100 included in the points basis. The basis is the actual payable price of products in the order after discounts; delivery and ancillary costs are excluded. For a discounted product, the discounted product price is used.
2.2. At launch, 100 welcome points are awarded for account confirmation, 50 points for installing the Wallet club card, and for a referral 150 points for the referring member and 50 for the referred person after their first purchase.
2.3. A member may optionally provide their date of birth. It is not a condition of membership; 50 points are awarded for providing it. Additional points for following social media or other profile activity apply only if actually activated on the Website and their conditions are communicated in advance.
2.4. Purchase-related points are credited immediately after purchase. If the order is later cancelled, withdrawn from, or refunded in whole or part, clause 6 governs adjustment.
3. Club levels
3.1. Snacker is available from HUF 0 annual spend and earns 1 point per HUF 100. Athlete is available from HUF 100,000 annual spend and earns at a 1.25 multiplier. Champion is available from HUF 500,000 annual spend and earns at a 1.5 multiplier.
3.2. The annual spending period begins on the date the member joins and is determined on a 12-month membership period. Earned club status does not expire and is not downgraded. Redeeming points does not reduce status points and does not affect earned club status.
4. Redeeming points and rewards
4.1. One point represents HUF 1 in discount value. 250, 500 and 1,000 points may be exchanged for discount coupons of HUF 250, HUF 500 and HUF 1,000 respectively; 400 points may be exchanged for a free-shipping coupon. The HUF 250, 500 and 1,000 coupons cannot be combined with another discount. No minimum order value applies. At launch, available discount and free-shipping coupons are valid until 31 December 2026. The free-shipping coupon may be used for packages up to 5 kg.
4.2. Points cannot be exchanged for cash, transferred or used outside the relevant member’s own account.
5. Validity of points
5.1. Points do not expire while the member remains active in the club. A member is active if at least one activity affecting the points balance occurs within 12 months, including earning points by purchase or redeeming points. If no such activity occurs for 12 consecutive months, the member is inactive and accumulated unused points expire.
6. Withdrawal, refunds and point adjustment
6.1. On full cancellation or full withdrawal, all points credited for the order are withdrawn. In the event of partial withdrawal or refund, only points credited for the refunded products are withdrawn proportionately.
6.2. If a Customer used a coupon redeemed from points, the Service Provider recredits points corresponding to the used coupon in case of full withdrawal. For a partial refund, the used discount is apportioned among the products and only points corresponding to the returned product(s) are recredited.
6.3. The Customer is entitled only to refund of amounts actually paid. A loyalty discount, points or coupon is not refundable in cash.
6.4. If points to be withdrawn have already been used, the Service Provider reduces the available balance to no less than zero. No negative balance arises and the difference is not deducted from later earned points.
7. Membership and programme changes
7.1. The Service Provider may suspend or terminate loyalty-programme membership, especially for fraud, abuse or unauthorised earning of points; supplying false data or creating multiple accounts to obtain unauthorised benefits; deliberate manipulation of the points system; or serious or repeated breach of programme rules.
7.2. The Service Provider may prospectively amend programme terms or discontinue the programme. Material adverse changes or discontinuation are notified at least 30 days in advance on the Website and/or at the member’s registered email address. A shorter period may be used where necessary due to a legislative change, authority requirement, security or abuse-prevention reason.
7.3. On programme termination, lawfully earned valid points and coupons may be used until the termination takes effect under these rules. This does not apply to membership terminated for fraud or abuse under clause 7.1.
8. Data processing
8.1. Detailed rules for processing personal data connected to the loyalty programme are contained in the Nanosupps Privacy Notice. JeriCommerce participates in the technical operation of the programme according to the purposes determined by Nanosupps and its actual contractual role.
